Terms and Conditions

These Website Standard Terms and Conditions, herein referred to as “The Terms,” shall govern your use of this Website, including but not limited to; all pages within the Website or linked via this Website.  The scope will be referred to as “The Website.”

The purchase of any SOCAVIVOR ticket via The Website will be considered an agreement of The Terms by the ticket purchaser, herein referred to as “Attendee(s).”  The Attendee agrees and acknowledges that The Terms are legally binding.  This document contains limitations on your rights and is expected to be reviewed by all Attendees.

The Terms apply in full force and effect with the commencement of the Attendee’s use of The Website.  Attendee agrees that using The Website before purchasing any event ticket is also considered an agreement to The Terms.  Attendees must not use The Website if they object to The Terms.

The Website is not for minors (defined as those who are not at least 18 years of age), and Attendees under 18 years of age must not use The Website.

RESTRICTIONS

You are expressly and emphatically restricted from all of the following: Publishing any Website material in any media; Selling, sublicensing, or otherwise commercializing any Website material; Publicly performing or showing any Website material; Using The Website in any way that is, or maybe, damaging to The Website; Using The Website in any way that impacts user access to The Website; Using The Website contrary to applicable laws and regulations, or in a way that causes, or may cause, harm to The Website, or any person or business entity; Engaging in any data mining, data harvesting, data extracting or any other similar activity about this Website, or while using The Website; Using The Website to engage in any advertising or marketing; Certain areas of The Website are restricted from access by Attendee and SOCAVIVOR may further restrict Attendee access to any areas of The Website, at any time, in its sole and absolute discretion.  Any user ID and password Attendee may have for The Website are confidential, and Attendee must maintain confidentiality of such information.

VARIATION OF THE TERMS

SOCAVIVOR is permitted to revise The Terms at any time as it sees fit, and by using The Website, you are expected to review such Terms regularly to ensure you understand all The Terms governing the use of The Website.

INTELLECTUAL PROPERTY RIGHTS

Other than the Content you own, which you may have opted to include on The Website, under these Terms, SOCAVIVOR and its licensors own all rights to the intellectual property and material contained in this Website, and all such rights are reserved.

You are granted a limited license only, subject to the restrictions provided in The Terms, for viewing the material on The Website.

YOUR CONTENT

“Your Content” shall herein mean any audio, video, text, images, or other material Attendee may choose to display on The Website.  Concerning Your Content, by displaying it, you grant SOCAVIVOR a non-exclusive, worldwide, irrevocable, royalty-free, sublicensable license to use, reproduce, adapt, publish, translate, and distribute it in any media.  Your Content must be your own and not infringe on any third party’s rights.  SOCAVIVOR reserves the right to remove any of Your Content from the Website at any time, and for any reason, without notice.

PHOTOGRAPHY/VIDEO RELEASE

Video/Audio recording, filming, and photography will occur during SOCAVIVOR events.  Such Content may be owned, licensed, assigned, or distributed nationwide and worldwide by SOCAVIVOR, their affiliate, and assignees.  Attendees agree, allow, waive, and authorize SOCAVIVOR, its affiliates, and assignees the right to use their likeness in any manner whatsoever.  Attendees understand they will not receive compensation for using such Content and waive any rights they may have to bring any action against SOCAVIVOR, their affiliates, and assignees for said use of Content captured while attendees any SOCAVIVOR event.

RIGHT TO CHANGE ITINERARY

SOCAVIVOR reserves the right, at any time, to change the event’s itineraries whenever advisable or necessary.  Such changes shall not constitute a cancellation/ refund.  In the event of a change to the itinerary, SOCAVIVOR will NOT be responsible for any loss or expenses caused by this change.

RIGHT TO CHANGE ARTISTS

SOCAVIVOR reserves the right to change any Artists originally scheduled to perform during our events.  Refunds will not be granted to Attendees due to such changes.

SOLICITATION

Solicitation or vending of any kind is not allowed during any of our SOCAVIVOR events.  Anyone violating this policy will have any unauthorized merchandise confiscated and forced to leave without a refund or compensation.  SOCAVIVOR will not be held liable nor assume responsibility for any unforeseen expenses that may arise for such an occurrence.  Refunds and/or any other compensations resulting from the removal of the offending Attendee will not be provided, nor will they be the responsibility of SOCAVIVOR.  For information on sponsoring and partnering with SOCAVIVOR, please email info@socavivor.com.

ZERO TOLERANCE POLICIES

Zero Tolerance Drug Policy

SOCAVIVOR has a zero-tolerance policy regarding using, possessing, purchasing, and distributing illegal controlled substances while attending our events.  Any violation of this policy will result in the immediate confiscation of said items and the removal of the offending Attendee.

SOCAVIVOR reserves the right to detain attendees who violate this policy and will not be held liable nor assume responsibility for any unforeseen expenses that may arise for such an occurrence.  Refunds and/or any other compensations resulting from the removal of the offending individual will not be provided, nor will they be the responsibility of SOCAVIVOR.

Zero Tolerance Threats & Violence

SOCAVIVOR has a zero-tolerance policy regarding threats and violence while attending our events.  This includes all physical and or verbal abuse.  Any threats, threatening behavior, instigation, and acts of violence against fellow attendees,  SOCAVIVOR Staff, or property will not be tolerated.  Any violation of this policy can result in the immediate removal of the offending Attendee and the individuals being turned over to the local law enforcement officials for appropriate legal action.  SOCAVIVOR reserves the right to detain attendees who violate this policy and will not be held liable nor assume responsibility for any unforeseen expenses that may arise for such an occurrence.  Refunds and/or any other compensations resulting from the removal of the offending individual will not be provided, nor will they be the responsibility of SOCAVIVOR.

Zero Tolerance Discrimination And Harassment

SOCAVIVOR has a zero-tolerance policy regarding discrimination and harassment of any kind, including but not limited to offensive or derogatory jokes, racial or ethnic slurs, unwanted sexual advances, and comments about a person’s religion or religious garments while traveling onboard any of our cruises.  This includes all physical and verbal abuse and assaults.  Any violation of this policy can result in the immediate removal of the offending Attendee and the individuals being turned over to the local law enforcement officials for appropriate legal action.  SOCAVIVOR reserves the right to detain attendees who violate this policy and will not be held liable nor assume responsibility for any unforeseen expenses that may arise for such an occurrence.  Refunds and/or any other compensations resulting from the removal of the offending individual will not be provided, nor will they be the responsibility of SOCAVIVOR.

 Zero Tolerance of Unbecoming Behavior

SOCAVIVOR has a zero-tolerance policy for disrespectful, unbecoming, or generally unpleasant behavior.  Shouting, cursing, and any unwarranted aggression towards SOCAVIVOR staff, performing artists, and fellow attendees will not be permitted.  Should this behavior continue and escalate, violation of this policy can result in the immediate removal of the offending Attendee and the individuals being turned over to the local law enforcement officials for appropriate legal action.  SOCAVIVOR reserves the right to detain attendees who violate this policy and will not be held liable nor assume responsibility for any unforeseen expenses that may arise for such an occurrence.  Refunds and/or any other compensations resulting from the removal of the offending individual will not be provided, nor will they be the responsibility of SOCAVIVOR.

SOCAVIVOR reserves the right to bar any violators of our zero-tolerance policies from future events.

CANCELLATION & REFUND POLICIES

Cancellation

In a natural disaster that causes the postponement or cancellation of any SOCAVIVOR event, attendees know that all funds paid towards SOCAVIVOR are still non-refundable.  Natural disasters, including but not limited to earthquakes, hurricanes, and pandemics, will not warrant a refund.  In the event of Non-Natural Disasters, including but not limited to strikes, lockouts, riots, or stoppage of labor for whatever causes or any other reason whatsoever beyond the control of SOCAVIVOR, SOCAVIVOR may cancel, advance, or postpone any scheduled event and may alter the venue locations should it be necessary.  SOCAVIVOR shall not be liable for any loss to attendees caused because of such cancellation, advancement, postponement, or substitution.

Refund Policy

All transactions are final.  All SOCAVIVOR event tickets are non-refundable once purchased.  Monies paid toward SOCAVIVOR are non-refundable and cannot be credited to a future year.

Fraud Claims

Should an error be found on your SOCAVIVOR receipts and statements, we ask you to contact Info@socavivor.com  or call our office at 305-438-9488 at your earliest convenience to review and adjust accordingly.  Please do not contact your bank or credit card company to reverse charges.  As reversing charges can appear as fraud claims, Attendees who initiate these claims can and will be subject to ticket cancellation without refund.  SOCAVIVOR will not be held liable for any expenses arising from such occurrences.  SOCAVIVOR reserves the right to red flag and bar such clients from future events.  Applicable chargeback fees will also be levied.

NO WARRANTIES

The Website is provided “as is,” with all faults, and SOCAVIVOR makes no express or implied representations or warranties of any kind related to the Website or the materials contained on The Website.  Additionally, nothing on this Website shall be construed as providing consult or advice to you. 

LIMITATION OF LIABILITY

In no event shall SOCAVIVOR, nor any of its officers, directors, and employees, be liable to attendees for anything arising out of or in any way connected with attendees’ use of  The  Website, whether such liability is under contract, tort or otherwise, and SOCAVIVOR, including its officers, directors, and employees shall not be liable for any indirect, consequential or special liability arising out of or in any way related to attendees use of The Website.

INDEMNIFICATION

Attendee hereby indemnifies to the fullest extent SOCAVIVOR from and against any liabilities, costs, demands, causes of action, damages( to Attendees person or property), and expenses (including reasonable attorney’s fees) arising out of or in any way related to your breach of any of the provisions of these Terms.

SAFETY

SOCAVIVOR encourages attendees to use their discernment and act with discretion while attending any SOCAVIVOR event.  Attendees agree that SOCAVIVOR assumes no responsibility and shall not be held liable for any loss of property, damage, injury, or delay to your person and property or party/group while attending any SOCAVIVOR event. 

SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions listed in The Terms.

ASSIGNMENT

SOCAVIVOR shall be permitted to assign, transfer, and subcontract its rights and obligations under The Terms without any notification or consent required.  However, you shall not be permitted to assign, transfer, or subcontract any of your rights and obligations under these Terms.

ENTIRE AGREEMENT

The Terms, including any legal notices and disclaimers contained on The Website, constitute the agreement between SOCAVIVOR and Attendee concerning Attendee’s use of The Website and supersede all prior agreements and understandings with respect to the same.

GOVERNING LAW & JURISDICTION

The Terms will be governed by and construed by the laws of the State of Florida, and Attendees submit to the non-exclusive jurisdiction of the state and federal courts located in Florida to resolve any disputes.
